| Today, I will be discussing a Pleading in the Alternative. Consider the following claim: "I never borrowed the lawn mower, it was broken when i borrowed it, and i returned it in perfect condition..." Does this seem a little odd to you? Apparently, courts allow such pleadings... I wont bore you with the reasoning behind why, but the short version is, it allows one to cover their behind. Figures.

| I can't say that I've necessarily been working as hard as I can. You would think with only school to worry about, one would spend a balance of time studying outside of class. Its amazing how much time you spend on needless things like sleeping and eating... ha. No really, I had to be honest with myself and realized that I've only been spending 3 or maybe for 4 hours a day studying outside of days where I have papers due.
So after this past weekend, where I must have spent a grand total of 5 hours actually studying, I had a mild panic attack when I realized there are only 1.5 months until finals... True, its still 6-7 weeks out and its not a big deal, but after looking over how much we have covered and how little I retained, I freaked out a bit. Like I said midway through September, its time to kick it up a notch. Seems like that got stalled a bit.
On another sobering note, I realized that my reasoning skills and ability to articulate concepts are still fairly sub-par and have a loooong way to go. Oh well, time to buckle down and get to working.

| We get to go on a field trip for our civil procedure class tomorrow! Yay! Our professor set up an opportunity for the class to sit in on a couple hearings at the US norther district court. The judge is going to take us back into his chambers and show us where all the work gets done.
The cases actually sound pretty interesting. In the first case, some goober company is making a product call Rollit. It is direct competition to the ever famous Post-it. The second case involves some suspended attorney that is trying to sue Jeep over a contract dispute regarding a canceled warranty policy. The problem is he is trying to be the attorney and the plaintiff...
Anyhow, I am looking forward to seeing how these guys argue their case.

| Wow, I haven't updated in a while but I'm still getting visitors. I have no idea who most of you are but thanks for stopping by. I actually started a post a week ago regarding concerns over networking (more on that later) but got wrapped up in some Civil Procedure reading.
Well, as the title states, I just flew by two milestones. The more significant of the two is the completion of my first month of law school! To answer a few questions, I am not a raging alcoholic (I still don't drink), I haven't hooked up with any law school hotties and I still enjoy law much more than I ever enjoyed engineering. Honestly, I can't believe how fast it has gone. How do I feel so far? Steady but still a bit shaky. We are far enough into the semester where I have something of a rhythm down and am beginning to get a broad sense of what we are doing. On the other hand, I still haven't quite developed the thought process and knowledge base necessary to be effective. Basically, I'm right where I expect to be... although I am finding myself slacking a bit more than I should.
So now that I've gotten the hang of things, its time to step it up a bit more. Reading and briefing cases isn't enough now. I have to take extra measures to develop the legal analytical skills and draw the connections between all the cases we have covered so far... I'm not exactly sure what that entails either, but thats what I'm here to find out!
The second milestone is passage from my mid twenties to my late twenties. Yes, I am now 28 as of the 16th of this month. The fact that I'm writing this two days after the fact should say something about how important I feel this particular milestone is. Ask me how I feel when I turn 30... As for the events of my birthday weekend, my roomie Ben took me out to lunch at "Crazy Buffet" - some local version of Todai, but not as good in my opinion.
The really fun event was going to a law party hosted by our Torts professors at their home in the Santa Cruz mountains. It was nice to hanging out with a lot of the other students in a very casual social environment. The highlight was when my Civil Procedure professor got up and sang some karaoke tunes. Oh, and when one of the students dedicated "Jail House Rock" to the criminal law prof. Classic.
Okay, I think thats enough for now. Time to dive back into case reading. I'll have to do a follow up to my opinion about my professors next time and find some pictures to break up all this text...

| I cant believe I'm already into my 3rd week of school. The good news is, I still very much enjoy law school. The bad news is I'm starting to slack a bit. No, I am still doing all my reading, but getting by with just enough is a really crappy mentality. Time to pick it up a bit.
Anyhow, as the title suggests, I'm experiencing a bit of nostalgia for things gone by. What is it that I miss? NOT engineering, NOT Cytec (althought I do miss some of the people, but I make a point to keep in touch with them). I DO miss looking out my window into our family backyard during the evening... seeing the mote flecked golden beams of sunlight filter through the trees to the backdrop of a red sky... I miss the smell of the Newport back bay and the cool breeze as I bike around the loop... I miss the Saturday evening dinners with my Pa...
Oh well, time is moving quickly and I have Fall Break coming up at the beginning of October. I'm looking forward to it!
